IMPORTANT: PLEASE READ THIS AGREEMENT BEFORE SUBMITTING YOUR APPLICATION OR RENEWING YOUR MEMBERSHIP. BY SUBMITTING AN APPLICATION YOU ARE AGREEING TO EACH OF THESE TERMS AND CONDITIONS OF MEMBERSHIP WITH BEDANDBREAKFAST.COM™ AND INNS.COM

  • 1. BedandBreakfast.com membership is a one-year agreement, and automatically renews every year, unless canceled by the innkeeper within 30 days prior to membership expiration. Innkeepers will be notified of their membership expiration via email and regular mail 30 days before their expiration date. The membership expiration date may also be viewed at any time by logging into the innkeeper’s BedandBreakfast.com Home Base. BedandBreakfast.com will automatically renew the annual membership at the same membership level and on the same payment plan, at the prevailing rates, if the innkeepers do not cancel their membership before their membership expiration date. Innkeepers on an annual payment plan will be charged the one-time annual fee, and innkeepers on the monthly plan will continue to be charged the monthly fee.
  • 2. Payments are made monthly by an automatic charge to your credit card (Visa, MasterCard, American Express, or Discover); U.S. and Canadian properties can pay monthly or annually using via a bank account.Membership can be pre-paid for the year at a reduced rate by credit card or from a bank account.
    • a. If you select online payment from your bank account, you are authorizing your bank to make automatic monthly bill payments to BedandBreakfast.com by debiting your bank account, and agree to the following terms: I remain in complete control of my payments; I will receive a receipt of my monthly charges and should I dispute any portion of the statement, I must notify BedandBreakfast.com at least three days prior to the due date; if I decide to cancel authorization of Automatic Bank Account Debit, I must notify BedandBreakfast.com at www.BedandBreakfast.com or by calling 1-800-462-2632 or 1-512-322-2700. Should my bank reject the automatic payment, BedandBreakfast.com may charge a return fee.
    • b. If you prefer to mail a completed, signed paper check for membership fees, you are authorizing us either to use information from your check to make a one-time electronic fund transfer from your account or to process the payment as a check transaction. When we use information from your check to make an electronic fund transfer, funds may be withdrawn from your account as soon as the same day we receive your payment, and you will not receive your check back from your financial institution. For security reasons we will destroy your original check, but we will keep a copy for record keeping purposes. By presenting your completed and signed check to us you authorize the conversion of your check into an electronic transaction in this manner. At this time only annual members can pay by mailing a check.
  • 3.IF MEMBERSHIP IS CANCELED AT ANY TIME AFTER THE 90-DAY GUARANTEE BUT BEFORE THE ONE-YEAR TERM IS FULFILLED, AN EARLY TERMINATION FEE APPLIES TO THE ONE (1) YEAR COMMITMENT. THIS FEE IS EQUAL TO THE AMOUNT OWED ON THE REMAINING TERM OF THE MEMBERSHIP AND WILL BE CHARGED AT THE TIME OF EARLY TERMINATION.
  • 4. Any membership changes made during the course of the one-year membership (upgrades, secondary listings, etc.) will be pro-rated according to the previously selected plan (monthly or annually). A 90-day money-back guarantee applies to all regularly-priced new and upgraded BedandBreakfast.com memberships. The 90-day guarantee does not apply to promotional membership offers.

All applications for membership are subject to BedandBreakfast.com's™ review process to ensure that your property meets the specifications of a bed and breakfast or country inn type property. Eligible properties must be less than 40 rooms unless they are historic in nature (greater than 50 years old). The primary listing for an eligible property will be in the city or town where it is physically located. Breakfast must be served or available on request, and can be included in the price or available at an extra charge; rooms must be individually decorated. Additionally, properties that are part of large chains with similar decor/architecture do not qualify. These include, but are not limited to: hotels/motels, vacation rentals, campgrounds, apartments and RV parks. If one company owns several inns, each property must be listed separately with its own BedandBreakfast.com membership. BedandBreakfast.com™ reserves the right to refuse membership to any property.

BedandBreakfast.com™ reserves the right, once your property is a member, to: Delete any organization that submits false or intentionally misleading information; market the BedandBreakfast.com™ database and individual properties from the information supplied by the member; restrict advertising to any entity for any reason; approve or reject any listing deemed objectionable.

By agreeing to these terms it is acknowledged that BedandBreakfast.com and Inns.com have the right to use, reproduce, modify, display and transmit on the BedandBreakfast.com website and any BedandBreakfast.com partner websites, any information, photos, videos, or other material provided by innkeeper and/or innkeepers' authorized agent. The undersigned agrees to grant BedandBreakfast.com an unrestricted, perpetual license for the use and/or distribution of any information, images, videos, or other materials representing the innkeeper's property in the promotion of the property, as well as the BedandBreakfast.com database on the Internet, in printed matter, in marketing materials, or in any other manner, marketing or otherwise, as deemed appropriate by BedandBreakfast.com. By agreeing to these terms it is acknowledged that the images and materials provided to BedandBreakfast.com are not restricted by copyright, or the innkeeper owns the copyright on the images and materials and authorizes the full use thereof by BedandBreakfast.com. The innkeeper agrees to indemnify and hold harmless BedandBreakfast.com from any claim, suit, damage or liability, which BedandBreakfast.com may incur as a result of use of such images or materials.

BEDANDBREAKFAST.COM™ MAKES NO WARRANTY PERTAINING TO AND IS NOT LIABLE FOR THE ACCURACY, COMPLETENESS, CURRENCY OR RELIABILITY OF ANY CONTENT OR LISTING DISPLAYED ON ITS WEBSITE(S). BEDANDBREAKFAST.COM™ SPECIFICALLY DISCLAIMS ANY AND ALL LIABILITY, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES PERTAINING TO ANY CLAIMS BASED ON OR ARISING FROM THE POSTING OF SUCH CONTENT OR LISTING THAT IS MADE AGAINST BEDANDBREAKFAST.COM™, INNKEEPERSONLY™, INNS&OUTS© OR THE BED & BREAKFAST CHANNEL™, OR ANY OF ITS AFFILIATES, SUBSIDIARIES, AND/OR RELATED COMPANIES.

BedandBreakfast.com™ is not bound to any changes or amendments to this agreement unless agreed to by BedandBreakfast.com™ in writing.

Miscellaneous: This Agreement shall be interpreted in accordance with the laws of the State of Texas, and any legal proceeding arising out of this Agreement will occur in Austin, Texas. This Agreement constitutes the entire agreement between BedandBreakfast.com™ and Participant with respect to the subject matter hereof, and Participant has not relied upon any promises or representations by BedandBreakfast.com™ with respect to the subject matter except as set forth herein.

BedandBreakfast.com Diamond Collection Terms and Conditions

IMPORTANT: PLEASE READ THIS AGREEMENT BEFORE SUBMITTING YOUR APPLICATION OR RENEWING YOUR MEMBERSHIP. BY SUBMITTING AN APPLICATION YOU ARE AGREEING TO EACH OF THESE TERMS AND CONDITIONS OF MEMBERSHIP WITH BEDANDBREAKFAST.COM AND INNS.COM AS WELL AS OUR STANDARD TERMS AND CONDITIONS AND PRIVACY POLICY

1.   Membership: The BedandBreakfast.com Diamond Collection membership is a one-year agreement, and automatically renews every year at the prevailing rates, unless the membership is canceled by the innkeeper within 30 days prior to membership expiration, or in the event of a breach of applicable terms and conditions, as described below.
Innkeepers will be notified of their membership expiration via email 30 days before their expiration date. The membership expiration date may also be viewed at any time by logging into the innkeeper’s BedandBreakfast.com Home Base. Innkeepers on an annual payment plan will be charged the one-time annual fee, and innkeepers on the monthly plan will continue to be charged the monthly fee.

BedandBreakfast.com Diamond Collection memberships can be revoked at any time if the Innkeeper is in breach of these or other applicable terms and conditions, including the failure of a property  to pass the formal inspection or maintain the BedandBreakfast.com Diamond Collection membership standards. If a property fails a formal inspection the Innkeeper will be notified within five (5) business days and their membership could be cancelled within ten (10) business days. If a property fails to meet the membership standards and criteria at any time during their membership, the Innkeeper will be notified within five (5) business days by BedandBreakfast.com with a description of the membership infraction and must then choose another level of BedandBreakfast.com membership for the duration of their one year commitment. The Innkeeper will have 30 days from the date of the notification to choose the new level. Innkeepers whose  fail an inspection or have their membership cancelled can re-apply for BedandBreakfast.com Diamond Collection membership after a period of  one (1) year in which time it is assumed the  necessary changes to the property will have been made to qualify for the Diamond Collection.

Any changes to BedandBreakfast.com Diamond Collection membership status made during the course of the one-year agreement will be pro-rated according to the previously selected BedandBreakfast.com plan (monthly or annually).
An Innkeeper with an expired or cancelled membership agrees to stop representing itself as a member of the BedandBreakfast.com Diamond Collection in any way including on any website, on their property, and in any marketing collateral.

2. Payments: The initial application fee may be paid in full at time of application by charge to a credit card (Visa, MasterCard, American Express, or Discover) or by check, or paid in three equal installments by charge to a credit card. This fee is non-refundable. Monthly membership fees are made monthly by an automatic charge to your credit card (Visa, MasterCard, American Express, or Discover); U.S. properties can pay monthly or annually using a bank account. Membership can be pre-paid for the year at a reduced rate by credit card or from a bank account.

a. If you, the Innkeeper, select online payment from your bank account, you are authorizing your bank to make automatic monthly bill payments to BedandBreakfast.com by debiting your bank account, and agree to the following terms: I, the Innkeeper, will remain in complete control of my payments; I will receive a receipt of my monthly charges and should I dispute any portion of the statement, I must notify BedandBreakfast.com at least three days prior to the due date; if I decide to cancel authorization of Automatic Bank Account Debit, I must notify BedandBreakfast.com at www.BedandBreakfast.com or by calling 1-800-462-2632 or 1-512-322-2700. 3. Membership Standards and Criteria: Each Innkeeper with a BedandBreakfast.com Diamond Collection property must meet the following minimum criteria to be considered for membership.

a. All applications for BedandBreakfast.com Diamond Collection membership are subject to BedandBreakfast.com's™ review process and formal inspection. Each BedandBreakfast.com Diamond Collection property must meet the specifications of a bed and breakfast or country inn type property. Eligible properties must be less than 40 rooms unless they are historic in nature (greater than 50 years old). Breakfast must be served or available on request, and can be included in the price or available at an extra charge; rooms must be individually decorated. Additionally, properties that are part of large chains with similar decor/architecture do not qualify. These include, but are not limited to: hotels/motels, vacation rentals, campgrounds, apartments and RV parks. Additionally, each property must meet and maintain all BedandBreakfast.com Diamond Collection standards and criteria. The primary listing for a Diamond Collection property will be in the city or town where it is physically located. If one Innkeeper or the Innkeeper’s company owns several inns, each property must be listed separately with its own BedandBreakfast.com membership.

b. Additionally, each BedandBreakfast.com Diamond Collection property must meet and maintain the following standards and criteria in order to be approved and remain in the BedandBreakfast.com Diamond Collection.  Each property must have or provide to its guests, as applicable:

  • Guest rooms with private attached bathrooms
  • Official certificate of occupancy and permit
  • All current applicable licenses including lodging, liquor, food and beverage, as well as mechanical elevator and fire safety permits
  • Current insurance coverage with at least US $1 million of comprehensive business liability
  • Free Internet service for guests
  • Online reservations on property website
  • Professional-quality photos on BedandBreakfast.com & property website
  • Flexible check-in or guaranteed late arrival
  • Staffing 7 days a week from 6AM to 8PM
  • 24 hour per day guest accessibility to service or staff
  • Accept BedandBreakfast.com Gift Cards
  • Maintains a 4.0 or higher BedandBreakfast.com consumer review rating
  • 10 or more consumer reviews on BedandBreakfast.com per membership year
  • Proactively maintains high customer satisfaction

c. Initial Property Inspection - Each BedandBreakfast.com Diamond Collection property must have an initial property inspection. BedandBreakfast.com works with an independent 3rd party, InnConcierge, to conduct formal initial property inspections. Properties that require a physical on-site inspection must schedule and complete an inspection within 90 days of their application date. Properties that have had a verifiable membership in good standing and a physical inspection from Select Registry, AAA Three Diamond, Mobil/Forbes Three Star rating, Relais & Chateaux are eligible for an offsite annual inspection. Properties may reschedule inspections in exigent circumstances; a minimum of four weeks notification is required for onsite inspections, and one week for offsite inspections. If a property reschedules more than twice, BedandBreakfast.com reserves the right to retain all or part of the application fee. BedandBreakfast.com reserves the right to refuse membership to any Innkeeper’s property.

d. Annual Renewal Process – Beginning on January 1, 2015, all Innkeepers with Diamond Collection properties, at the date of their annual membership renewal, will have had to have collected 10 or more reviews in the preceding 12 months with an average rating of 4.0 or greater, for each property, to qualify for automatic renewal of the Diamond Collection certification.  After January 1, 2015, if an Innkeeper fails to meet either the quantity of reviews or the cumulative rating requirements, for any of their properties, they are required to have a phone call from a Diamond Collection inspector to answer questions about their business operations.  If the Diamond Collection inspector is not satisfied that any of the Innkeeper’s property is adhering to the Diamond Collection standards of quality, there will be a mandatory on-property inspection conducted of a similar nature to the Initial Property Inspection, the cost of which will be borne by the Innkeeper.  Prior to January 1, 2015, the renewal qualifications will be directly communicated to the Innkeepers via email and will be based on their individual circumstances.

We strongly recommend that BedandBreakfast.com Diamond Collection applicants do not apply unless they have been open for business for at least one full year. During the first few months of a new operation, there are often many uncertainties and unexpected issues that may arise, so we encourage applicants to wait until the business is more established. If the applicant has been open under a year and is approved, they should be made aware that they are being granted an exception to the above ruling due to their own personal hospitality and innkeeping experience or because they have already been pre-approved by one of BedandBreakfast.com's list of criteria partners, such as Select Registry, AAA 3-Diamond, Relais et Chateaux, or Mobil 3 Star.

BedandBreakfast.com reserves the right, once your property is a member, to exercise all its rights under its Terms and Conditions and Privacy Policy.
