Featured Property Auction, Terms & Conditions
IMPORTANT: PLEASE READ THIS AGREEMENT BEFORE PARTICIPATING IN THE
FEATURED PROPERTY AUCTION™ PROGRAM. BY COMPLETING THE PARTICIPATION PROCESS,
YOU ARE AGREEING TO EACH OF THESE TERMS AND CONDITIONS OF THE FEATURED PROPERTY
AUCTION PROGRAM™ WITH BEDANDBREAKFAST.COM™.
All members in the Featured Property Auction Program™ must be current members
of BedandBreakfast.com™ at the Bronze, Silver, Gold or Platinum Membership
level. Featured Property™ advertisements shall display the main property
photograph as defined in the BedandBreakfast.com™ database, the property name,
city and state. Silver, Gold and Platinum members may choose to have the
Featured Property™ advertisement link to either the property’s listing on
BedandBreakfast.com™, or the property’s own homepage/website.
To participate in the Featured Property Auction™ Program, the participating
property must open a Featured Property Auction Account™ (FPA Account™) with
BedandBreakfast.com™. To open an account, a minimum $25.00 U.S. deposit is
required. All deposits to the property’s FPA Account™ are NON-REFUNDABLE. The
Balance in the FPA Account™ will be used to pay for impressions served on pages
for which the property is the high bidder. The member property may advertise on
any available city, region, State/Province, country page on the
BedandBreakfast.com™ site.
The minimum bid to place a Featured Property Advertisement on any page shall be
$.01 U.S. per Featured Property™ advertisement displayed (impression). A
Featured property advertisement shall be deemed served when a user of the
BedandBreakfast.com™ website loads a page on his or her computer on which a
Featured Property™ advertisement has been placed. There is no maximum bid. Once
a property has placed the high bid for a page, the property will continue to be
the Featured Property™ on the page until one of the following events,
notwithstanding other terms of this agreement, occurs.

Another property has placed a higher bid for the same page.

The property has insufficient funds in their FPA Account™.

The property’s membership with BedandBreakfast.com™ expires.

The property cancels their winning bid
When there has been no activity in a FPA Account for a period of 90 days, the
account shall be deemed dormant. Activity shall be defined as any monetary
change to the FPA Account™. Additionally, if a property’s regular membership
with BedandBreakfast.com™ expires, the FPA Account™ shall immediately be deemed
dormant. BedandBreakfast.com™ shall charge a $5.00 per month maintenance fee
against all dormant accounts.
BedandBreakfast.com™ reserves the right to: refuse participation in the
Featured Property Auction™ Program to any member as well as revoke the
membership of any organization that submits false or intentionally misleading
information.
BedandBreakfast.com™ makes no warranty pertaining to and is not liable for the
accuracy, completeness, currency or reliability OF ANY content or listing
displayed on its Web site(s). BedandBreakfast.com™ specifically disclaims any
and all liability, whether based in contract, tort, strict liability or
otherwise, for any direct, indirect, incidental, consequential, or special
damages pertaining to any claims based on or arising from the posting of such
content or listing that is made against BedandBreakfast.com™, InnkeepersOnly™,
Inns&Outs™ or The Bed & Breakfast Channel™ , or any of its affiliates,
subsidiaries, and/or related companies.
BedandBreakfast.com™ is not bound to any changes or amendments to this
agreement unless agreed to by BedandBreakfast.com™ in writing.
Miscellaneous: This Agreement shall be interpreted in accordance with
the laws of the State of Texas and any legal proceeding arising out of this
Agreement will occur in Austin, Texas. This Agreement constitutes the entire
agreement between BedandBreakfast.com™ and Participant with respect to the
subject matter hereof, and Participant has not relied upon any promises or
representations by BedandBreakfast.com™ with respect to the subject matter
except as set forth herein.
