This gift certificate/gift card ("Certificate") is sold by BedandBreakfast.com, Austin, Texas, in accordance with the following terms and conditions ("Terms"). These Terms constitute the entire agreement and your possession or use of this Certificate constitutes your acceptance of these Terms. All terms and conditions apply equally to BedandBreakfast.com Gift Certificates, The Bed and Breakfast Card, and The Getaway Gift Card from BedandBreakfast.com.

BedandBreakfast.com gift certificates issued after August 31, 2005, do not expire.

All Certificates are issued in U.S. dollars.

Certificates are not redeemable for cash and are non-refundable, except where prohibited by law.
Reproduction of BedandBreakfast.com Certificates/Cards not in accordance with our terms and conditions is strictly prohibited.

BedandBreakfast.com certificates and cards can be redeemed by the holder of the Certificate (the "Holder") for up to the face value of the Certificate for "qualifying services" at "participating properties". To redeem this Certificate, Holder must provide innkeeper with order and certificate numbers when making a reservation.

BedandBreakfast.com Gift Certificates and Cards are valid only at participating U.S. and Canadian properties. NOT ALL B&Bs AND INNS LISTED ON BEDANDBREAKFAST.COM PARTICIPATE IN THIS PROGRAM. Participating properties and qualifying services are subject to change. Before planning a stay, be sure to check the then current qualifying services and then current participating properties at the BedandBreakfast.com website. Innkeepers have no obligation to accept gift certificates in payment for group services, including accommodations and catering for weddings and other large functions, nor are they obligated to accept them along with buy-one-get-one-free coupons or other third-party promotions.

ALL PROPERTY SPECIFIC POLICIES, INCLUDING DEPOSIT, MINIMUM STAY AND CANCELLATION POLICIES APPLY. NOT VALID ON GROUP RESERVATIONS, CORPORATE RATES, OR WITH THIRD-PARTY COUPONS OR CERTIFICATES.

When redeeming a gift certificate/card, you may be asked to present a photo ID and a valid credit card.

For security reasons, BedandBreakfast.com Gift Cards and Certificates cannot be used to pay for a stay directly with a participating property or by using BedandBreakfast.com Online Reservations until a check-in date of at least seven (7) days after the gift card purchase date.

When redeeming a gift certificate/card at a property located in Canada, the property will determine the exchange rate used to calculate the value of your certificate/card in Canadian Dollars Any unused balances will remain in U.S. Dollars.

BedandBreakfast.com is not liable for lost or stolen gift certificates/cards.

BedandBreakfast.com Gift Certificates, The Getaway Gift Card, and The Bed and Breakfast Card are issued by CardFact, Ltd.

If a certificate/card is presented for qualifying services with a price of less than the face value of the certificate/card, the unused amount will remain on the certificate/card and can be used for other qualifying services or for future stays.

The certificate/card holder is responsible for all taxes, duties, fees, gratuities and assessments arising out of use of this Certificate.

When uploading photos/images/files/material (“material”) for customized gift cards, you agree not to:

• Upload material that is unlawful, indecent, pornographic, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable, or that could harm minors in any way.
• Upload any material that infringes any patent, trademark, copyright, right of privacy, or other proprietary rights of any party.

By uploading material you grant us a limited, royalty-free and non-exclusive license to use, adapt, transmit, transfer, store, copy and display the images solely in connection with our providing gift cards to you. You represent and warrant that the uploaded images are in the public domain; or that you have full rights to these images; or that you have express permission to use these images; and that the use of these images do not infringe on the proprietary rights of others. The content of all uploaded material is subject to applicable laws (including laws which prohibit infringement of copyrights and trademarks, obscenity, pornography, child pornography, or child abuse). We have no obligation to monitor these materials.

BedandBreakfast.com warrants that this certificate/card can be redeemed in accordance with the terms and conditions above. B&B.com makes no other warranty or representation, and the implied warranties of MERCHANTABILITY and FITNESS FOR A PARTICULAR PURPOSE ARE EXPRESSLY EXCLUDED. IN NO EVENT SHALL B&B.COM BE LIABLE FOR COMPENSATORY, INCIDENTAL, INDIRECT, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES. IF B&B'S LIMITED WARRANTY OR LIMITATION OF LIABILITY SHALL FOR ANY REASON WHATSOEVER BE HELD UNENFORCEABLE OR INAPPLICABLE, HOLDER AGREES THAT B&B'S LIABILITY SHALL NOT EXCEED THE SUM OF ONE U.S. DOLLAR. Because some states or jurisdictions do not allow the exclusion or limitation of implied warranties or liability, the above limitation may not apply to you.
All issues and disputes regarding these Terms, or the rights and obligations of the parties, shall be governed by the substantive laws of the State of Texas without reference to conflicts principles, and shall be determined by binding arbitration under the commercial rules of the American Arbitration Association ("AAA"), at the office of the AAA nearest B&B.com's principal place of business.
